Un informe realizado por el Comité Selecto de Inteligencia del Senado y difundido ayer documenta que la tortura empleada por la Agencia Central de Inteligencia de Estados Unidos (CIA, por sus siglas en inglés), a raíz de los ataques del 11-9 fue aún más brutal de lo que se sabía previamente. El texto da cuenta del uso de técnicas de tortura, entre ellas el ahogamiento simulado, el sometimiento de los detenidos, la privación de sueño durante varios días, las amenazas de muerte y la aplicación de inyecciones por vía rectal. El informe también acusa a la CIA de engañar de manera rutinaria a legisladores, la Casa Blanca y al público en general sobre el alcance, dimensión del programa de interrogatorios y cárceles clandestinas operadas por esa corporación en decenas de países.

La difusión de este documento ha servido de argumento a la Casa Blanca para justificar su decisión de anular dicho programa pero, al mismo tiempo, ha sacado a relucir, de nueva cuenta, el carácter ambiguo y la mezquindad característica de Barack Obama en lo que toca a estos temas: lejos de formular un deslinde claro e inequívoco frente a dichas prácticas, el mandatario realizó una defensa apenas embozada de la labor de las agencias de inteligencia y el gobierno de su antecesor George W. Bush en su cruzadaantiterrorista; ha señalado dentro de este contexto que se cometieron algunos errores y ha pedido que no se reactiven viejas discusiones con este informe.
Por lo demás, debe recordarse que Wa-shington ha permanecido impasible ante la difusión de otros crímenes agraviantes perpetrados por su aparato militar y de inteligencia, dentro y fuera de Estados Unidos, tanto en décadas pasadas como en años recientes. Desde 1997 Washington reconoció que la CIA participó en el entrenamiento y el financiamiento de los torturadores empleados por la dictadura militar instaurada en Chile el 11 de septiembre de 1973.

Hace más de tres lustros, el Pentágono desclasificó siete manuales de contrainsurgencia, elaborados en décadas anteriores, que contenían instrucciones precisas para torturar a detenidos; de la CIA se conocen al menos cuatro documentos similares, hechos públicos en esa misma época.
Más tarde, tales conocimientos fueron ampliados por las revelaciones de Chelsea Manning –difundidas, a su vez, por Wikileaks– sobre algunos crímenes de lesa humanidad que las fuerzas estadunidenses cometieron en Irak y Afganistán.
En todo caso, la información del Comité Selecto de Inteligencia constituye un agravante adicional al descrédito del gobierno estadunidense, y coloca la barbarie como una práctica sistemática y una tendencia estructural en ese país. Ahora que se señala que la CIA engañó al Capitolio durante años, cabe recordar que ambas instituciones han transgredido en forma sistemática, deliberada y programada las leyes internacionales, estadunidenses y de otros países, y violado de la misma manera los derechos humanos de incontables personas.
Lo verdaderamente reprobable no es que las prácticas de tortura de la CIA hayan sido más brutales de lo que se suponía, sino el empleo de esas prácticas como recurso de la política, la economía, los negocios o el pretendido fortalecimiento de la legalidad por parte de la superpotencia."

In my perspective as lawyer abroad, the Mayor of London, Mr. Boris Johnson, Switzerland's people, and authorities --among other countries-- have been those who really have given to the world a great Rule of Law's lesson.

As a person accused, on reasonable grounds of torture, war crimes and crimes against humanity, Canada is legally bound to ensure that George W. Bush does not receive safe haven from prosecution in Canada. Canada’s elected representatives must fulfill this duty either by ensuring that George W. Bush is barred from entering Canada, or if he enters the country, taking measures to ensure he is prosecuted in Canada or extradited to a country willing and able to prosecute. We request you to take effective action to ensure that George W. Bush does not receive in Canada, in violation of the law, safe haven from prosecution for torture and other grave crimes. We call on all Members of Parliament and other elected representatives to:

· Advise G.W. Bush that, as a person accused on reasonable grounds of complicity in torture and other war crimes and crimes against humanity, he is not admissible to Canada unless and until such accusations have been tried and dismissed by a competent court; and,

· Advise G.W. Bush that if he enters Canada, he risks arrest and prosecution in Canada or extradition to another country for prosecution; and,

· Advise G.W. Bush that notwithstanding your silence in the past on this issue, you will do everything in your power to ensure that that he is held accountable in accordance with the law for the crimes of which he is accused; and,

· Advise the Attorney General of Canada to prevent Bush from entering Canada or to approve criminal proceedings against him under the Criminal Code or the Crimes against Humanity and War Crimes Act.

We remind you of your duty as elected representatives to uphold the law and the rule of law, to ensure the equal application of the law and to oppose efforts to flout the law to benefit political or economic allies such as George W. Bush. Your failure or refusal to apply the law coupled with efforts to shield George W. Bush from the law, effectively provide license to other heads of state to engage in widespread and illegal acts of war, war crimes and crimes against humanity: acts that have caused the death, injury, displacement and enforced disappearances of millions of innocent people in Iraq alone.
